By accessing or using BidKit ("the Service"), including any calculators, estimators, proposal generators, or contract generators available on this website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

BidKit provides free online cost estimation calculators for creative professionals. The Service includes:

Free cost estimation calculators for video production and other creative services
Summary and print/export features (free)
Professional proposal and contract generation (paid feature)

3. Estimates Are Not Quotes

The calculations and estimates provided by BidKit are for informational and planning purposes only. They do not constitute a quote, bid, invoice, or binding agreement. Actual project costs may vary significantly based on market conditions, location, project complexity, and other factors. BidKit makes no guarantees about the accuracy, completeness, or suitability of any estimate generated by the Service.

4. Generated Documents Disclaimer

The proposals and contracts generated by BidKit are templates intended as starting points. They do not constitute legal advice. You are solely responsible for reviewing, customizing, and ensuring that any generated document meets your specific needs and complies with applicable laws in your jurisdiction. We strongly recommend having any contract reviewed by a qualified attorney before use.

5. Paid Features

Certain features of the Service require a one-time payment processed through our third-party payment provider (currently Lemon Squeezy). By purchasing a paid feature:

You receive a license key that unlocks the feature in your browser
The license is for your personal or business use
Refunds are handled in accordance with our payment provider's policies
We reserve the right to change pricing at any time; existing purchases are not affected

6. Data and Privacy

All estimate data you enter into the calculator is stored locally in your web browser (via localStorage). We do not collect, store, or transmit your estimate data to any server. See our Privacy Policy for full details on data handling.

7. Intellectual Property

The BidKit name, logo, calculator code, and website design are the intellectual property of BidKit. The documents (proposals, contracts) you generate using the Service are yours to use for your business purposes. You may not resell, redistribute, or sublicense the BidKit tool itself or its paid features.

8. Limitation of Liability

To the maximum extent permitted by applicable law, BidKit and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

Your use of or inability to use the Service
Any errors, inaccuracies, or omissions in the estimates or generated documents
Any reliance you place on estimates, proposals, or contracts generated by the Service
Any unauthorized access to or use of our servers and/or any personal information stored therein

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes by updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new terms.

11. Governing Law
